AFFLINK PRIVACY POLICY

This Privacy Policy describes the privacy practices of AFFLINK, LLC (referred to in this Policy as “AFFLINK,” “AFFLINK,LLC,” “we,” or “us”), which is a division of Performance Food Group, Inc. (http://www.pfgc.com/).  This Privacy Policy describes how AFFLINK collects, uses, and shares your personal information when you access our website and apps.  Your continued use of our website and/or apps means that you accept the terms of this Privacy Policy.     

This Policy is based on our fundamental goal to provide our customers, users, and visitors with quality services, information, and resources while respecting their personal privacy.

We collect different types of information about you depending on your contact point with us and how you interact with us.  Some information you may provide directly.  Other information may be collected automatically.

A. Information you provide to us

Some of the personal information we collect is information you provide directly to us—for example when you seek information about a product or service you have purchased or are interested in purchasing.  We may also collect personal information you post publicly on any of our social media pages, as well as information about our products or services that you choose to post online in publicly accessible forums (i.e., product reviews).

Account and Purchase Information

When you register to establish an account with Elevate Marketplace, you provide certain information such as your name, email address, company, phone number, mailing address, shipping address, billing address, password, credit card number and order history.  We use that information for the purpose of determining whether to establish a business relationship with you, processing payment for the goods and services you purchase from us, and communicating with you about our goods and services.  We do not use your credit card information for any purpose other than facilitating your purchases from us.

Offline Collection

At times we might collect information from you through means other than our website and apps.  For example, if you call to place an order or to check on the status of an order, we will collect telephone numbers or other information needed to communicate with you.

B. Information we collect automatically

In addition to information you provide to us, AFFLINK may also use various methods to collect certain kinds of information automatically through your use of our website and apps, including: your IP address, the pages you view on our website, the duration of your visit, the pages you view immediately before and after you access our website, search terms you enter on our website, and information about the type of browser and operating system you use as well as your location.  We primarily collect this information using technologies such as:

Each of these technologies is discussed in more detail below, along with some other technologies we may use to collect personal information.

We treat all personal information that we collect with the same confidentiality, no matter how it is collected.  For example, we do not sell any of the information we collect to third parties.  

Cookies

A "cookie" is an element of data that a website can send to your browser, which may then be stored on your computer system.  It can help provide you with a tailored user experience, to understand your preferences and to personalize the content you see.  Some of our website’s pages may use cookies. 

You may be able to have your browser warn you when a cookie is sent, and you may be able to turn off all cookies.  You can do this through your web browser settings.  Each browser is different, so look at your browser’s Help menu to learn the correct way to modify your cookie settings.  Our homepage is also equipped with a pop-up banner, allowing you to accept the use of cookies or view our privacy policy when you first visit our website. 

Please note that turning cookies off may cause you to lose access to some features of our website or cause some pages of our website to not function properly.

Web Beacons (a/k/a “tracking pixels”)

Web beacons are often-transparent images that can be placed in web pages and some forms of email that communicate information from your Internet browser to a web server.  Web beacons can be used to deliver cookies and to collect certain personal information about you.  For example, we may use web beacons to count the number of your visits to our website, check whether you have viewed a particular web page or email message, and determine, among other things, the time and date on which you viewed the web beacon, the IP address of your computer, and the URL of the web page from which the web beacon was viewed.  We use web beacons for a variety of purposes, including analyzing the traffic patterns on our website and in conjunction with cookies to provide content and ads that are more relevant to you.

Removing existing cookies from your browser and turning off the browser’s acceptance of cookies will generally prevent web beacons from tracking your activity.

HTTP Referrers

An HTTP referrer is a tool that captures information passed along by a web browser that references the web URL from which you came to our website.  Referrers are automatically collected by Performance Foodservice’s web servers.  Performance Foodservice uses referrers to identify the websites referring traffic to our website, and to present more relevant content to our website’s users.  Referrer information may be used by Performance Foodservice to identify general trends and traffic patterns among its users. 

Some browsers allow you to restrict the transfer of referrer data by selecting the preferred option in the browser’s settings and/or by running the browser in “private” mode.  Please consult your browser’s help menu for more information on these options.  

Other Examples of Technologies We May Use

In addition to the tools discussed above, we may use other kinds of local storage, such as Local Shared Objects (sometimes referred to as “Flash cookies”) and HTML5 local storage in connection with our website and apps.  These technologies are similar to the cookies discussed above in that they are stored on your computer and can be used to store data about your activities and preferences.  However, these objects are stored in different parts of your computer from ordinary browser cookies.  Many Internet browsers allow you to disable HTML5 local storage or delete information contained in HTML5 local storage using browser controls.

Other technical methods may involve HTML e-mails that we send visitors to our website, from which we then can determine whether the visitors opened those e-mails and/or clicked on links in those e-mails.

If you communicate with our employees and other staff members via email, telephone or other electronic channels, our information technology systems record details of those communications, sometimes including their content, for compliance and record-keeping purposes.  Any such recording is done in compliance with applicable law.

4. INFORMATION AFFLINK SHARES WITH OTHERS

We do not sell your personal information, including your email address.

At times, however, AFFLINK must disclose information about our customers to our contractors, business partners, and third-party service providers.  We engage third-party service providers to improve the security of our website, to help us understand how users engage with our website, and to facilitate your purchases of our products and services.  Service providers may also be involved in payment processing, web analytics, data processing, advertising or email distribution, or administering sweepstakes, contests and other promotions that may require registration and other services.

AFFLINK requires its contractors, business partners, and service providers to use your information in accordance with the terms of this Privacy Policy.  AFFLINK may disclose personal information to its contractors, business partners, and service providers without additional notice to you.  Our contractors, business partners, and service providers may only use the information we provide them for the purpose of carrying out their services, and may not otherwise use or share your information.  

These third parties may use cookies and similar technologies to collect information about your use of our website as well as information about your use of other websites over time.  Sharing this information with analytics providers assists us primarily with improving the security, functionality, and experience of our website and apps.

AFFLINK may also disclose to others information regarding your access and use of our website, provided that it is that is de-identified and aggregated with other data.  This information might include referrer information and the other information that we collect through our website.

Third-Party Web Services

The third-party services we may use for our website include, but may not be limited to: Google reCAPTCHA, Google Analytics, and others.

Before accessing certain portions of our website, users may be directed to first use the Google reCAPTCHA tool so that an integrity check can be performed to ensure the user is not a bot.  Through this tool, Google collects hardware and software information, such as device and application data, in order to perform these integrity checks. 

We use Google Analytics to better understand how users interact with our website, and tailor our marketing to their individual interests.

5. How We Respond to “Do Not Track” Signals

Your browser and other technology may have a “do-not-track” setting that sends signals to websites with the technology to receive them, to express your preferences regarding online tracking.  We do not currently have the technology to respond to such signals, but may in the future.  If you are a California resident who wishes to opt out of sharing personal information with us, please see the instructions for submitting such requests, below.

Third-parties, such as Google Analytics, may collect data that relates to you on our website, across time, and over other websites.  Third-parties’ responsiveness to do-not-track signals is governed by their privacy policies.

6. Your California Privacy Rights

If you are a resident of California, your right to submit certain requests relating to your personal information is described below.  Please note that when submitting a request, you will be asked to provide information to verify your identity before action is taken.  You may designate an authorized agent to make the requests below on your behalf.  An authorized agent must submit proof to us that he or she has been authorized by you to act on your behalf, and you will need to verify your identity directly with us through the process described below.

A. Right to Opt Out of the Selling of Your Personal Information

B. Right to Request More Information

If you are a California resident, you have the right to request more information regarding the following, to the extent applicable:

Please note that due to the different requirements of the applicable laws, our response times may vary depending on the specific type(s) of information sought.  We respond to all verifiable requests for information as soon as we reasonably can, and no later than legally required.  

C. Right to Request Deletion of Your Personal Information

California residents also have the right to request that we delete your personal information collected or maintained by us.  Once we receive your request, we will let you know what, if any, personal information we can delete from our records, and we will direct any service providers (such as Google Analytics) that may have collected personal information about you through our website to delete your personal information from their records.  There may be circumstances where we cannot delete your personal information or direct service providers to delete your personal information from their records.  For example, if we need to: (1) retain your personal information to complete a transaction or provide services; (2) detect security incidents; (3) protect against unlawful activities; (4) identify, debug or repair errors; or (5) comply with a legal obligation.  You may submit a request to delete your personal information by calling us at 855-488-7364, emailing us at customerservice@elevatemarketplace.com, or submitting a completed form available at https://www.elevatemarketplace.com/contactus.In connection with submission of your request, we will take steps to verify your identity as outlined below, and you will need to verify your identity before action is taken.

D. Verification of Requests for Further Information or to Delete Personal Information

Upon submission of a request for information or a request to delete information, we will take reasonable steps to confirm that the person submitting the request to know or request to delete is the person to whom the information relates, and to prevent unauthorized access or deletion of information.  The specific steps taken to verify the identity of the requesting person may vary based on the nature of the request, including the type, sensitivity and value of the information requested, the risk of harm posed by unauthorized access or deletion, the likelihood that fraudulent or malicious actors may seek the information, the robustness of personal information provided to verify your identity, the nature of our business relationship with you, and available technology for verification. 

We will generally try to avoid requesting additional information from you for the purpose of verification, but we may need to do so if we cannot verify your identity based on the information already maintained by us.  If we request additional information to verify your identity, it will be for that purpose only, and will be deleted as soon as practical after processing the request, except as otherwise provided by law. 

The following generally describes the verification processes we use:

  • Password Protected Accounts.  If you have a password-protected account with us, we may use existing authentication practices to verify your identity, but will require re-authentication before disclosing or deleting data.  If we suspect fraudulent or malicious activity relating to your account, we will require further verification (as described below) before complying with a request to know or delete.
  • Verification for Non-Accountholders.  If you do not have, or cannot access, a password-protected account with us, we will generally verify your identity as follows:

o   For requests to know categories of personal information, we will verify your identity to a reasonable degree of certainty by matching at least two data points provided by you with reliable data points maintained by us.

o   For requests to know specific pieces of personal information, we will verify your identity to a reasonably high degree of certainty by matching at least three data points provided by you with reliable data points maintained by us.  We will also require a declaration, signed under penalty of perjury, that the person requesting the information is the person whose information is the subject of the request.  We will maintain all signed declarations as part of our records.

o   For requests to delete personal information, we will verify your identity to a reasonable degree or a reasonably high degree of certainty depending on the sensitivity of the personal information and the risk of harm posed by unauthorized deletion.  We will act in good faith when determining the appropriate standard to apply.

If there is no reasonable method by which we can verify your identity, we will state so in response to a request to know or delete personal information, including an explanation of why we have no reasonable method to verify your identity.

E. Right to Non-Discrimination for the Exercise of Your Privacy Rights

If you choose to exercise any of the privacy rights conferred by the California Consumer Privacy Act of 2018, you also have the right not to receive discriminatory treatment by us.  This means that, consistent with California law, we will not deny providing our services to you, charge you different prices or provide a different level or quality of services to you unless those differences are related to the value of your personal information.

7. CHANGES TO PERFORMANCE FOODSERVICE’S PRIVACY POLICY

Our use of the information that we collect about you is subject to the Privacy Policy in effect at the time the information is provided or collected.  However, we may change this Privacy Policy from time to time.  You should check our website periodically for changes to our Privacy Policy.  Your continued use of our website or apps after the effective date of any modification to the Privacy Policy will be deemed to be your agreement to the changed terms.
